The relevant bits of the EULA are these, IMHO:

  • You may not rent, sell, lease, lend, offer on a pay-per-play or timesharing basis or otherwise commercially exploit or commercially distribute your Variations
  • If you Distribute, or permit others to Distribute, your Variations, you hereby grant back to Infogrames and BioWare an irrevocable royalty-free right to use and distribute such Variations by any means, and to make such modifications thereto as Infogrames and/or BioWare deem are necessary to package, combine, and otherwise distribute such Variations.

Regarding the HcR flap: If I understand what I am reading here, they HAVE distributed the code, which gives Bioware the rights to use, modify, or redistribute. It does not seem to grant those same rights to the community or render the code "open source". I still maintain that it is "open source" by it's very nature. However, If the current developers of the code do not want outside help (as is their stated position on their own fora), then I won't give them any. I've found other systems that seem to do what I want with less bulk anyway. HcR is an EXCELLENT system for running peristent worlds. It's far too code heavy and bulky for single player or small group session based play. -- Klingon Mage
